First Nitrogen Gas Execution Set In Alabama

Kenneth Eugene Smith will be put to death with the gas later this month, as ruled by District Judge R Austin Huffaker.

The decision, criticized by Smith’s attorneys as cruel and experimental, allows for the first execution using this method in the United States, set for January 25.

Smith’s lawyers plan to appeal, arguing that the state is making him a “test subject” for an untried execution method.
